Assumable mortgages in the DMV

By Rich Jones

FHA, VA, and USDA loans can sometimes be assumed, which means a buyer takes over the seller’s existing loan. Conventional loans usually cannot be assumed. Even when a loan is assumable, you still go through underwriting, pay a fee, and cover the gap if the price is higher than the unpaid principal. A listing remark that says “assumable” is not the same as a closed assumption.

What an assumption transfers

You step into the seller’s existing loan, including its rate and remaining term, if the lender or investor allows it and you qualify. Each program has its own rules. VA assumptions have entitlement questions for the seller, FHA assumptions have their own credit and occupancy requirements, and USDA has more limited options and a property location test. You can see the basics on my loan programs page. This post covers what is different when a loan is assumed.

Here is the part buyers often miss. If the contract price is $150,000 above the unpaid principal, you still have to cover that gap with cash, a second loan, or a new first mortgage in place of the assumption. A low rate on a small remaining balance does not finance the rest of a Bethesda price. A new purchase loan may be cleaner than piecing together a gap.

Timelines

Servicers are often slow, and condo buildings still have their own paperwork on top of the loan. I will not promise a 30-day assumption because a flyer said so. If the seller needs a fast close, a standard purchase may beat an assumption that is stuck in a queue.

Limits to keep in mind

I will not tell a veteran to give up remaining entitlement without walking through the release first. Most conventional loans are not assumable. And your credit still gets reviewed even when the existing rate looks attractive.

Common questions

Can I assume a conventional mortgage?

Usually no. FHA, VA, and USDA are the programs where assumption is even a conversation.

Does the seller stay on the hook after a VA assumption?

Release of liability and entitlement restoration are specific steps. A handshake does not release the seller, so we follow the VA process.

What if the house costs more than the remaining loan?

The gap still has to be paid, with cash, a second loan, or a different structure. The assumed rate does not cover the difference between the price and the remaining loan.

Next step

Every assumption follows the guidelines of the loan it comes with. Contact me with your occupancy, income, and property type, and I will tell you what can close.
